Probate
Probate is the legal process through which a deceased person’s assets are transferred to their heirs or beneficiaries and any outstanding debts are settled. Whether your loved one had a valid will or passed away without one, probate is often a necessary step in handling their estate.
At Merrell & McDuff, our attorneys have extensive experience in both probate administration and probate litigation. We regularly work with individuals who have been appointed as personal representatives, guiding them through the legal and financial responsibilities that come with administering an estate.
What We Handle
Our team offers comprehensive support throughout the probate process, including:
Petitioning and applying for probate administration
Filing and proving a decedent’s last will and testament
Managing estate debts and communicating with creditors
Locating, notifying, and communicating with heirs or other interested parties
Distributing assets according to the will or state law
Preparing and filing required court documents and forms
What to Expect
The probate process can take time—typically around 12 months from opening to closing the estate. The required steps and legal paperwork can be complex and overwhelming, especially during a season of grief.
Our goal is to help you navigate this process with clarity and compassion. We’ll take the time to explain each step, ensure all deadlines are met, and advocate on your behalf in court if disputes arise.
Preparing for Your First Appointment
For your initial meeting regarding estate administration, please bring the following:
The original Last Will and Testament (if there is one)
A certified copy of the death certificate
A list of the names and current addresses of any heirs or beneficiaries
If you’re unsure where to begin, we’ll walk you through it. We understand this can be a difficult time, and we’re here to support you with both legal expertise and compassion.
